These Terms & Conditions (“Terms”) govern your access to and use of services provided by SHAPE Fitness & Education (“SHAPE”, “we”, “our”, or “us”).

By booking a consultation, enrolling in training, purchasing a package, registering for classes, or enrolling in educational programs, you agree to these Terms.

1. Scope of Services

SHAPE provides:

  • Personal Training (Solo, Double, Triple packages)

  • Gender-specific group classes

  • Consultations

  • Educational certification programs

  • Professional development courses

  • Digital educational content

  • Workshops and seminars

Services may be delivered in-person or online.

2. Eligibility

By enrolling in any service, you confirm:

  • You are legally capable of entering a contract

  • Information provided is accurate

  • You meet eligibility requirements for certification programs (where applicable)

For gender-specific services, enrollment is restricted to the designated gender category.

3. Consultations

Only 30-minute consultations are bookable online.

Consultations are introductory sessions and do not guarantee service acceptance or program approval.

SHAPE reserves the right to decline service where safety, compliance, or operational concerns exist.

4. Personal Training Services

A. Packages

  • PT services are sold in structured session packages.

  • Packages must be used within the validity period communicated at purchase.

  • Unused sessions after expiration are forfeited unless otherwise agreed in writing.

B. Scheduling

  • Sessions are subject to coach availability.

  • Late cancellations or no-shows may result in session deduction.

C. Health Responsibility

Clients must disclose relevant medical conditions before participation.

Participation is voluntary and undertaken at the client’s own risk.

5. Group Classes

  • Memberships are valid for the defined duration.

  • Access is limited to the specific class enrolled.

  • SHAPE reserves the right to modify schedules if operationally required.

Failure to renew membership may result in suspension of access.

6. Education & Certification Programs

A. Enrollment

Enrollment in certification programs does not guarantee certification. Participants must meet all academic and assessment requirements.

B. Third-Party Certification Bodies

Where SHAPE partners with international certification organizations, candidates agree to comply with the standards and policies of the respective certification body.

SHAPE is not responsible for decisions made by third-party certification organizations.

C. Examination & Results

Exam scheduling, eligibility approval, and credential issuance may be governed by the certification partner’s policies.

7. Payments

  • Payments must be made in full prior to service activation unless otherwise agreed.

  • Payment methods may include secure third-party processors.

  • SHAPE does not store full card details.

Failure to complete payment may result in suspension of services.

8. Refund Policy

Unless otherwise specified in writing:

  • PT packages are non-refundable once activated.

  • Class memberships are non-refundable after commencement.

  • Educational program fees are non-refundable once course access is granted.

  • Administrative or registration fees (if applicable) are non-refundable.

Refunds, if approved, are issued at SHAPE’s sole discretion.

9. Cancellation & Termination

SHAPE reserves the right to suspend or terminate services if a participant:

  • Violates policies

  • Engages in misconduct

  • Fails to comply with safety standards

  • Breaches payment obligations

No refunds will be issued in cases of policy violations.

10. Assumption of Risk & Liability Waiver

Physical training involves inherent risks including injury.

By participating, you:

  • Voluntarily assume all risks

  • Release SHAPE, its coaches, and staff from liability for injuries arising from participation, except in cases of proven gross negligence

Participants are encouraged to seek medical clearance before beginning training.

11. Medical Disclaimer

SHAPE does not provide medical diagnosis or treatment.

All fitness and nutrition guidance is educational and performance-based in nature.

Participants should consult qualified healthcare professionals for medical concerns.

12. Intellectual Property

All materials including:

  • Course content

  • Manuals

  • Videos

  • Assessments

  • Branding

  • Logos

  • Website content

are the intellectual property of SHAPE or its partners.

Unauthorized reproduction, distribution, or resale is strictly prohibited.

13. Data Protection

Personal data is handled in accordance with SHAPE’s Privacy Policy.

Participants consent to data processing necessary for service delivery and certification administration.

14. Limitation of Liability

To the maximum extent permitted by law, SHAPE shall not be liable for:

  • Indirect or consequential damages

  • Loss of income

  • Certification denial by third-party bodies

  • Technical disruptions beyond reasonable control

Total liability shall not exceed the amount paid for the specific service in dispute.

15. Force Majeure

SHAPE shall not be held liable for service interruption due to:

  • Government regulations

  • Natural disasters

  • Public health restrictions

  • Technical failures

  • Events beyond reasonable control

16. Amendments

SHAPE reserves the right to amend these Terms at any time.

Continued use of services constitutes acceptance of updated Terms.

17. Governing Law

These Terms are governed by the laws of the Sultanate of Oman.

Any disputes shall be subject to the jurisdiction of Omani courts.
